Two Important Decisions By Courts

The courts are becoming more and more active and their activeness is proving beneficial to the people in addition to preserving justice.

Hyderabad: Just days after the Supreme Court ordered cancellation of 214 of 218 coal block sanctions, the Bangalore special court gave another important judgement convicting the Tamil Nadu CM Jayalalitha in the case against her confirming that she owned assets disproportionate to the known incomes.

To partly repair the damage done to the country and the economy in view of illogical allocation of coal blocks, the Supreme Court ordered cancellation of 214 allocations. The CAG mentioned in its reports that the improper allocations (simply called as ‘Coal Gate’) caused huge loss to the economy.

The UPA government that ordered allocation of coal blocks (as they deem fit), ensured all possible steps to delay the process of restoring natural justice. The government with Dr. Manmohan Singh as Prime Minister also went to the extent of reporting to the Supreme Court that the relevant files (in coal allocation) are missing. The court did make serious objections to the casual attitude of the government wherein huge amounts (running more than 1.5 lacs crores of public money) are involved.

Now with the new government in place in Delhi, the formalities as required by the court are completed and the Supreme Court ordered cancellation of 214 allocations. Now it is the turn of the Government of India to ensure proper recovery, if any and ensure that proper re-allocation of coal blocks is done. This is to be taken on top priority.

Almost in the similar way, the Bangalore special court convicted the Tamil Nadu Chief Minister Jayalalitha in the case popularly known as ‘DA Case’. Jayalalitha along with 3 more accused in the case have been ordered to go to prison for 4 years. This judgement by the special court is a decision on petition filed by Subramanyam Swamy (former president of Janata Party).

The above two judgements are going to have a long lasting effect in the minds of Indians. While the Supreme Court assured justice (against improper allocation by government), the Bangalore court decision is also going to have a large scale changes in the political scenario in the state of Tamil Nadu.

Based on the judgement Purachi Talaivi can’t rule the state. In the recent general elections, Tamilnadu people gave more than expected support to her and she could steer the party to victory almost single handed. She (along with other regional players like Mamata Banerjee from West Bengal, Naveen Patnaik from Odisha) were giving tough competition to BJP and NDA at centre.

Now the after-effects of the judgement (in Jayalalithaa’s case) will be known in couple of weeks’ time.
